Question about the law and martial arts?

In Canada, deadly force is only allowed to prevent loss of life or serious bodily harm. Canadian laws also make it very difficult for people to defend themselves with anything, but their hands and feet.

Our laws are less restrictive and deadly force is allowed in situations of self defense, defense of property, defense of others, and defense of other people's property. Deadly force may also be used to prevent a criminal from fleeing the scene of their crime. We are allowed to defend ourselves with or without a weapon against armed or unarmed assailants.

Hey you guys, do you realize this guy is talking about Canadian law? They are different from US laws. Much stricter but unfortunately I do not know a whole lot of details either. The problem is not so much if you think someone is going to seriously harm you but to prove it afterwards too when you did kill your attacker and if his family has a crafty lawyer they can really twist things to your disadvantage. So a lot of times things do not even become a matter of right or wrong or what is the law and what isn't but what is allowed admissible evidence in court which can greatly influence the outcome of a trial if you have to go to court.

As KW says it depends much on the country. I live in Sweden and here you are allowed to use as much force as needed to protect yourself and end the situation in your favor so to speak. However, they are very strict on how much force you use.

A while ago a guy got 3 months prison because he used too much force.

As stated, I would check the laws in your particular area. My grandfather as well as one of my instructors always say. "I'd rather be judged by 12 than carried by 6" And I feel the same way. If your trying to take my life and the ONLY way I can stop you is to take yours. It's not a hard decision for me....

But back to your question. As far as the legal trouble you'll be in. That will vary by state, country etc. But....you know, you'll have your life

i am also a black belt. i assume you could not dial 911 for help but you cannot use deadly force unless confronted with deadly force. i have always taught my students when in that type of situation, fight to the death

Legally, you're alright so long as you only do what's required to remove the threat to your person.

Practically, this means that the moment they stop being a threat, you stop hurting them.

You have to prove your level of force was justified. Witnesses, a weapon or you could be trying to convince the court.

Martial Artist's don't have laws. Only the laws of the fist. Also don't have sex with children

Murder

Hey guys.

So I'm a martial artist and there's something I've always wondered about. Say I'm in a situation where someone is trying to do serious bodily harm to me. There's no chance to run away and I have to use my skills to defend myself, but that person is killed. What legal trouble could I get into in Canada if this happened?
